(hereinafter "SORTU SOLUTIONS"), located at Calle la Mascota #533, Colonia San Benito, San Salvador, makes these Terms and Conditions (hereinafter the "Terms") available to its visitors, customers, and/or contractors (hereinafter the "User(s)"). These Terms regulate the SORTU SOLUTIONS website. Any transaction made through this Website will be subject to the terms and conditions expressed herein.

SORTU SOLUTIONS may modify the content of the Website at any time and does not assume any commitment to update it at any particular time. The User has the possibility to consult, verify, or ratify any information contained on the Website through the contact details provided for this purpose.

Acceptance of the Terms and Conditions 

The User consents to and agrees to comply with all the provisions of these Terms by accessing the domain https://sortusolutions.com/ (hereinafter the “Website”).

The User declares that they are over 18 (eighteen) years old and have sufficient legal capacity to assume rights and obligations; otherwise, the User must refrain from using the Website, either directly or indirectly, as well as from using any information or service presented here.

The Terms and Conditions of the Website are aimed at regulating the use of the website and other online services offered by SORTU SOLUTIONS, so it is essential for the User to understand that these Conditions do not alter the terms and conditions of any other agreement that may have been entered into with SORTU SOLUTIONS.

The User declares that, by entering the Website, they agree with the content of the terms and conditions established herein, as well as with any updates made by SORTU SOLUTIONS.

The User acknowledges that, due to the technological nature of the Website, it will be subject to changes according to available trends and innovations and in compliance with current regulations. 

The User agrees that by using any tool on the SORTU SOLUTIONS website, they are expressing their free and voluntary consent to this legal instrument, equivalent to entering into a contract with their handwritten signature.

Purpose of the Terms and Conditions

The use of the Website will be exclusively for the User to personally consult information related to the Products and/or Services that SORTU SOLUTIONS offers for sale through it. Therefore, no other use may be made of the Website. It is prohibited to copy, forward, reproduce, reuse, sell, transmit, distribute, download, license, modify, publish, or use the content of the Website in any other way for public or commercial purposes. In no case may it be understood or interpreted that any concession or license regarding any intellectual property right is being granted or given. Linking or referencing the Website is not allowed unless expressly permitted in writing by SORTU SOLUTIONS.

User Obligations

Each time the User uses the Website, they are obliged to:

• Use this site in accordance with the Terms and Conditions established here and with the Conditions of Use available within it;
• Conduct legitimate transactions, either on their own behalf or as a legally authorized representative;
• Assume responsibility for all charges, fees, and taxes associated with transactions made;
• Provide truthful, accurate, and legally valid information required to carry out the purchase or sale of the products offered here;
• Not access third-party information through this site;
• Not allow unauthorized third parties to conduct transactions through the site without your consent; and
• Not impersonate another person or entity, nor use or provide a false email address or one that is not yours.

All Services contracted by the User through this Website will be governed by these Terms and Conditions of contracting and by the applicable legal provisions. 

SORTU SOLUTIONS sells its Services through the Website, and the characteristics of each will be described on the Website. SORTU SOLUTIONS commits to carrying out the Services exactly as expressed in the content of this Website.

The prices of each of the Services offered will be published on the Website; these prices will be clearly identifiable and attributable to each respective Service. 

Payment for Services

- Payment on the Website

• To carry out the transaction for contracting through this Website, the User must have a credit or debit card duly issued by a legally constituted Banking Institution, or one of the payment methods available at SORTU SOLUTIONS, and authorize the charge intended to be made as a result of contracting the Services.
• The contracting transaction is managed by an Authorized Payment Processing Provider, so SORTU SOLUTIONS does not store, process, or transmit the Client's banking data. In adherence to best practices, SORTU SOLUTIONS ensures that the Authorized Provider holds the Payment Card Industry Data Security Standard (hereinafter "PCI") certifications. Even though SORTU SOLUTIONS uses industry-standard measures to protect its Website, it advises the User to take care of their card number and expiration date, excluding the security code, which will not be stored by the Authorized Provider to protect the Client's confidential information. Consequently, SORTU SOLUTIONS is not responsible for any damages or misuse of the aforementioned data.
• Regarding the payment method via Bank Transfer, the Client will have a maximum of 24 (twenty-four) hours to make the full payment of their purchase order, starting from the moment SORTU SOLUTIONS confirms the order and notifies the User of the relevant details to complete the Bank Transfer via the registered email; otherwise, the order will be canceled.
• Once the transaction for contracting the corresponding Service on this Website has been completed and the payment has been authorized by the Banking Institution of the credit or debit card, or credited as appropriate for another payment method, a screen will appear indicating to the User that they have received an email with the next steps for the execution of the contracted Services.

– - Returns

• All returns and refunds are as established in the Returns Policy on this same Website.

- Currency of the Transaction

• The currency used in transactions conducted through this Website will be in US Dollars, the legal tender of the United States of America.

Intellectual Property

The contents of the Website, such as text, information, graphics, images, logos, trademarks, computer programs, databases, designs, APIs, functional architecture, and any other material (hereinafter, "the Content"), are protected by applicable industrial property laws, whether registered or not, in the country or abroad. All Content is the property of SORTU SOLUTIONS and/or any other subsidiary, affiliate, branch, agency, representatives, controlling entities, controlled entities, linked entities, and any natural or legal person that may be related to SORTU SOLUTIONS and its content.

The compilation, interconnection, operation, and arrangement of the contents of this Website are the exclusive property of SORTU SOLUTIONS and/or its affiliated companies. The User is authorized to navigate and view the elements of the website for personal and non-profit use, refraining from performing any act of decompilation, reverse engineering, modification, disclosure, or supply. Unauthorized use, adaptation, reproduction, and/or commercialization of the Content may be punishable by current legislation.

Confidentiality

SORTU SOLUTIONS and the User shall keep confidential any information provided in or for the execution of the Services, or which by its nature should be treated as such, and agree not to use it for their own benefit or that of third parties. Information that is in the public domain, disclosed by SORTU SOLUTIONS or the User, and information that must be disclosed in accordance with laws or by a court order or competent authority, shall not be considered Confidential Information.

In the event that the provision of the Services involves the need to access personal data, the parties shall adhere to the Privacy Policies established in the Notice available on the SORTU SOLUTIONS website.

SORTU SOLUTIONS shall not be liable for damages and claims by third parties arising from errors resulting from the User's lack of diligence in handling information about any Service.

Additionally, the obligations established for SORTU SOLUTIONS and the User shall also be binding on their respective employees, external and internal collaborators, and subcontractors. However, considering the nature of this contract, the User consents and authorizes SORTU SOLUTIONS to share with third-party providers the information necessary to provide the contracted service.

Service Responsibility

The User agrees to defend, indemnify, and hold harmless SORTU SOLUTIONS, its independent contractors, service providers, and consultants, and their respective directors, employees, and agents, from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorney fees) arising out of or in relation to: (a) your use of the Services, (b) any User Content or comments you provide, (c) your violation of these Terms, (d) your violation of any rights of another, or (e) your conduct in relation to the Services.

Limitation of Liability

The User declares and agrees that the use of the Services is at their sole and exclusive risk. SORTU SOLUTIONS reserves the right to suspend and/or interrupt the Service at its sole discretion. SORTU SOLUTIONS assumes no responsibility for the operation of the website used by the User to access the Service, nor for those related to or caused by third-party service providers and/or any other service provided by persons other than SORTU SOLUTIONS.

In no event shall SORTU SOLUTIONS, its directors, employees, or agents be liable for any direct damages, losses, or any other damages of any kind, arising out of or in any way related to the use or inability to use the website, SORTU SOLUTIONS materials, content, or materials contained in or accessed through the Services, including without limitation damages caused by errors, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from natural disasters, communication failure, theft, destruction, or unauthorized access to records, programs, or services.

Furthermore, under no circumstances shall SORTU SOLUTIONS total liability, whether in contract, warranty, strict liability, or otherwise, arising out of or in connection with the use or inability to use the services, exceed any compensation paid to SORTU SOLUTIONS for access to or use of the Services.

Termination and Suspension of Service

Notwithstanding the Terms and Conditions, the User agrees that SORTU SOLUTIONS reserves the right, without prior notice and at its discretion, to deny, terminate, or unilaterally suspend the Service. The User agrees that a notification issued electronically by SORTU SOLUTIONS stating that the User does not meet the requirements established herein is sufficient for this circumstance to apply. Any Service may be suspended if there is suspicion of involvement in operations or behaviors that are illegitimate, contrary to law, or to what is established in these Conditions.

Termination

SORTU SOLUTIONS may terminate these Terms and Conditions entered into with the User in case of non-compliance by the latter with any of the obligations established herein. SORTU SOLUTIONS shall be entitled to compensation for damages caused, and it shall be sufficient for SORTU SOLUTIONS to notify the User by email with the right to compensation for damages caused in case of non-compliance with the obligations established therein, and unilaterally, it shall be sufficient for such purposes to notify the User by email. The User agrees that SORTU SOLUTIONS may request payment for damages caused and any other balance, commission, or fine.

Privacy Policy and Personal Data Protection

SORTU SOLUTIONS undertakes to comply with applicable legislation regarding the protection of personal data. Personal data provided by Users will be processed in accordance with SORTU SOLUTIONS Privacy Notice, which is available on this Website. Users consent to the processing of their personal data in accordance with said notice.

Communication with the User

The User agrees that all communications, notifications, agreements, and other information provided electronically (e.g., by email or text message) by SORTU SOLUTIONS satisfy any legal requirement that such communications be in writing. The User acknowledges that electronic communications have the same validity as communications on paper and will be deemed received at the time of sending.

Partial Nullity

If any provision of these Terms and Conditions is deemed invalid, illegal, or unenforceable by a competent court, such provision shall be deemed severed from the rest of the document and shall not affect the validity or enforceability of the remaining provisions. The remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
